hey guys, benda et al did a great job today highlighting the education required at the level of the courts… my feeling is that courts are captured, but it still helps to showcase that, and not only that - meanwhile i think MOST people need to be doing other kinds of work while matt and team take care of that, as it seems it will continue to be a long process
this is supreme court a23-0302, this is a case that started in rice around august 2022 (yes, almost three years ago) and is today at supreme court with request from benda to return to district court to proceed, decision which will likely not occur for at least 90 days but could easily be longer, at which point going back to district court and then proceeding would take yet more time, but then discovery, depositions, and the fun stuff could happen
one justice asked benda, what mischief is possible with modems, and respectfully this is an ignorant question for anyone in 2025, but it did allow elaboration on the point that there are indeed modems in a number of tabulators from ES&S, the DS200, i call them deep state 200s, which going back to 2020 the same model had embedded (not advertised) telit modems… telit’s board has connections to ccp, so it’s all very interesting and pretty much what you expect nowadays
meanwhile the people know there are internet-connected modems and the attorney from rice county (representing their county auditor) tried to say they aren’t turned on during the election, without any proof of that, when we also have printouts from public accuracy tests showing they are active… you would have to have some way to turn it on and off, but i haven’t seen any audit logs from actual elections to prove they are somehow off
to top it off, these modems are certified for the DS200s in Minnesota and this is a point the attorney for Steve Simon didn’t want to go into… his arguments focus on Procedure, which is pretty much all of what the public policy courts are these days… not interested in the law, only Procedure, and occasionally the minnesota statutes, which both say modems CANNOT be in tabulators but also have a carve-out saying they CAN be in order to transmit after-poll-close data to county/sos. our election statutes, heavily influenced by sos and lobbyists who are in league with sos, are a complete joke, unless considering that they are indeed sinister and evil by design
today showed once again that after 3 years the appelants are still being asked dumb questions about whether they followed Procedure or could have filed a different way or could have served 130 candidates on the ballot or if bringing up this HUGE SOFT spot in Minnesota (and nationwide) elections is really what they want to be doing…
the big turnout - the bailiff had a surprised look on his face when entering, i’m told - shows that people care about this and i don’t see why any of them will go anywhere… many have faced ridicule, isolation, lawsuits, fines, and bullets, so it’s not like this group, and it’s a small group, from one perspective, but a big group when considering all the quiet support they have… this is the year of retribution for innocent

i expect many cities and towns (and even counties) will decide to drop Simon’s sensors once they find out they allow data to leave the precinct and then be used to influence otucomes… not great when a local race can be changed directly with those internet-connected iPads
